This program is brought to you with your well-being and safety in mind. To participate in a Qigong or Tai Chi program offered by Gellman Acupuncture, LLC & Robin Gellman the undersigned:
Agrees that by joining any Tai Chi/Qigong or any wellness program offered by Robin Gellman, LAc. or Gellman Acupuncture, LLC, whether in-person classes, private lessons, workshops, or video/online classes, you are agreeing to this Waiver and Release of Liability for any and all reasons..
Recognizes the nature of this activity requires physical exercise, physical exertion and perhaps the risk of injury. Certifies that, to the best of their knowledge, has no physical disability or problem that would cause such physical exertion to endanger their health. Recognizes that it is their responsibility to notify the instructor of any serious illness or injury, or any change of health status, including pregnancy.
Acknowledges and fully understands that each participant will be engaging in activities that involve physical contact (to include push hands exercises and applications drills that involve pushing and pulling) where loss of balance, risk of serious injury, including permanent disability and death, and severe social and economic losses might result not only from their own actions, inactions, or negligence but also the action, inaction, or negligence of others, the rules of conduct, or the condition of the premises or any equipment used. Further, that other risks may exist that are not known or not reasonably foreseeable at this time.
Acknowledges that they will not perform any movements to the extent of strain or pain and adapt the movements to stay within their personal physical capacity and comfort levels. Assumes all the foregoing risks and accept personal responsibility for the damages following such injury, permanent disability, or death.
Acknowledges and fully understands that discussions on the health benefits of tai chi and qigong are not meant as a substitute for proper medical care and that these discussions are meant for education purposes and not meant to diagnose, treat, or cure medical conditions.
Acknowledges that during live online Zoom sessions, the instructor may not be able to see participants for a number of reasons: if the participants camera is disabled, for unexpected and unforeseen technical reasons, or because the instructor’s view does not show your camera. As such, participants should exert extra caution, assuming that the instructor cannot see you, and take full responsibility to stay within their ability level, adapt the movements accordingly. Whether with live or recorded sessions, the participant understands that they are following online material at their own risk. The participant acknowledges that all Zoom sessions may be recorded, and any recordings may be made available to clients of Gellman Acupuncture, LLC at a later date.
Expressly waive, release, hold harmless, and covenant not to sue Robin Gellman (Instructor) or Gellman Acupuncture, LLC for any and all rights and claims for damages or costs which I, my heirs, or my next of kin may have against him for personal injury, including permanent disability and death, or property damage suffered by me or that I may cause to others as a result of my participation in this class.
Acknowledges that when the class is being taught virtually on Zoom, the participant must provide a safe personal space to practice and that Zoom classes still involve inherent risks, including the possibility of injuries due to improper Qigong or Tai Chi form or unforeseen circumstances related to the virtual environment; and waive, release, hold harmless, and covenant not to sue Robin Gellman (Instructor) or Gellman Acupuncture, LLC for any and all rights and claims for damages or costs which I, my heirs, or my next of kin may have against him for personal injury, including permanent disability and death, or property damage suffered by me or that I may cause to others as a result of my participation in this virtual class.
